The present General Conditions of Purchase regulate the use of the web scalextric.es (hereinafter “La Web”) of which Scale Competition Xtreme, S.L (hereinafter SCX) is holder. Scale Competition Xtreme, S.L. is a limited commercial company with social domicile in Marqués de la Ensenada street no 14, 1-15 28004 Madrid, Spain, provided by NIF no B87608782, and registered in the Commercial Registry of Madrid, M- 631493, volume 35114, Folio 11, Secc.8. The customer's use of online shop services presupposes, in any case, adherence to the General Conditions of Purchase in the version published at the time of the purchase order. Therefore, it is convenient for the customer to read these General Conditions before proceeding to make a purchase.
1.- Contract scope
The present General Conditions of Purchase apply to the sale of all articles of SCX through its website in Spain. SCX reports that its website is directed exclusively to a public over 18 years of age. SCX reserves the right to cancel a customer's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.
2.- Limit of purchase
For security reasons, no purchases over €100,000 or more than 50 items per order can be made.
3.- Price
The applicable prices are those indicated on the website at the date of the order. Prices are detailed in each article and include the I.V.A (Added Value Tax), IGIC (Canary Indirect General Tax), or IPSI (Production Tax, Services and Import in Ceuta and Melilla), as appropriate. The amount of shipping costs is indicated to the customer in a disaggregated manner at the time of the order.
4.- Payment
Payment will be made at the end of the purchase process and will be an indispensable condition for the formalization of the purchase process. In no case may the payment be made subsequently. Payment is not supported by deferred procedures such as shipment against refund, transfer or payment at the time of order collection. Payment methods admitted: Purchases can be paid by Visa®, Mastercard® credit card as well as by 4B or 4B Master, Instant Credit and PayPal System debit card. In any case, the choice of payment means is made during the purchase process on the corresponding screen.
The customer must notify SCX of any undue or fraudulent charge on the card used for purchases, by email or by telephone, in the shortest possible time so that he can make the necessary arrangements. Providers or broadcasters may take anti-fraud measures that result in the rejection of certain types of operations. SCX is not responsible for implementing this type of security policies.
5.- Delivery
The delivery time will be up to 30 calendar days from the realization of the purchase. The delivery of the orders will be carried out in the direction indicated by the customer according to the following characteristics:
5.1 Home delivery:
Standard delivery: The customer must pay the transportation costs in Spain, in Europe or in the rest of the countries.
- In the case of shipments to Ceuta and Melilla, the customer must also pay the customs and taxes that generate the order. These expenses are paid at the time the order is received and in no case will they be included in the price paid for the products.
- In the case of shipments to the Canary Islands, the customer must also pay the management expenses in the Customs that generate the order and the AEIM regardless of the order amount where applicable. In addition, the customer must pay the corresponding tax. These expenses are paid at the time the order is received and in no case will they be included in the price paid for the products.
The address indicated by the client may be a particular domicile, a workplace or any other address indicated. It is not necessary that the invoice address and the shipping address coincide. Our shipping provider will send an email or SMS (if you have provided a contact phone on your order) indicating the day the delivery will be made and allowing the date of delivery to be changed. The same day on which delivery is scheduled, our shipping provider will send an email or SMS (if you have provided a contact phone on your order) informing about the approximate time slot.
5.2 Incidences in delivery:
If you are unable to make the delivery due to the absence of the recipient, the transport agency will leave an indicative note and attempt to contact the recipient by phone. After two failed attempts, the customer must contact the transport agency to proceed with the delivery.
6.- Changes, returns and withdrawal
There are different procedures for making changes, returns and withdrawals. Then we will describe the characteristics of each of them, as well as their costs and conditions.
- Change: the replacement is considered to be changed.
- Return: in case of tara or defect.
- Disruption: by customer decision.
All products to be changed or returned must be properly packed.
In case of withdrawal you will only be responsible for the decrease in the value of the goods resulting from a manipulation other than the necessary to establish the nature, characteristics and operation of the goods.
6.1 Conditions, reimbursement and procedure
Conditions (Changes and withdrawal): You have 14 natural days from the receipt of the product/s to desist from the contract without justification. We do not make changes as such, so you will have to make the return and make a new order with the new product.
Conditions (Devolutions): SCX will respond to the breaches of conformity that are manifested within the period established in the legal regulation.
Refund: SCX will refund, if any, the corresponding amount without undue delay and, in any case, before 14 calendar days have elapsed from the date on which the refund has been reported. The refund will be made by the same means of payment with which it was paid. However, we may retain the refund until you have received the goods, or until you have submitted a proof of the return of the goods, according to what condition is first met.

7.- Availability of products
If there are incidents of supply or if there are no products in stock, the customer will be informed immediately and refund of the amount of the product or products without stock will be made. SCX will refund the corresponding amount without undue delay and, in any case, before 14 calendar days have passed. The refund will be made by the same means of payment with which it was paid.
8.- Guarantee of the purchased products
The guarantee is provided in Royal Legislative Decree 1/2007 of 16 November, which approves the consolidated text of the General Law for the Defence of Consumers and Users.

The SCX Customer Service will assist and respond to your claim as soon as possible, and in any case within a maximum of one month. In the event that your request is not satisfactorily resolved, you may go to the ordinary jurisdiction or process your claim through the website http://ec.europa.eu/odrwhich will provide a single point of access for extrajudicial resolution free.
10.- Modification of general terms of purchase
SCX reserves the right at any time to modify the present General Conditions of Purchase. No modification will affect any orders that are already in progress.
11.- Force
Compliance by SCX with all or part of its obligations shall be suspended in the event of an incidental or force majeure case that prevents or withdraws compliance. They will be considered as such, in particular, without this list being limited: war, riots, insurrection, social disturbances, strikes of any nature and problems of supply not attributable to SCX. SCX will inform the customer of such a fortuitous or force majeure case within seven days of its occurrence. In the event that such suspension extends beyond a period of fifteen days, the client will then have the possibility of rescinding the current order and will then proceed to its reimbursement under the conditions provided for in item 6 of these General Conditions of Purchase.
12.- Applicable law and jurisdiction
These General Conditions of Purchase are subject to Spanish law. Without prejudice to the above, the non-resident consumer in Spain also enjoys the protection that guarantees him the peremptory provisions of the law of the country where he has his habitual residence. The parties are subject, at their choice, to the resolution of conflicts and with resignation from any other jurisdiction, to the courts and tribunals of the client ' s home.
